Terms of Service

These terms govern your organisation's use of SafeProG, the EHS management platform provided by SafePro Global Consultancy. Please read them — they set out what we owe you, what you owe us, and what happens if either of us wants to stop.

1.Who you are contracting with

SafeProG is provided by SafePro Global Consultancy, registered in Ireland.

“We”, “us” and “our” mean SafePro Global Consultancy. “You” means the organisation that subscribes to SafeProG, and the people it authorises to use the platform.

2.Your account and your users

  • An organisation account is created for you, and an administrator in your organisation controls who else has access.
  • Each person needs their own named account. Sharing credentials between people defeats the audit trail that makes the platform useful as evidence, and is not permitted.
  • You are responsible for what your users do on the platform, and for telling us promptly if you believe an account has been compromised.
  • We may suspend an account that is being used to attack the service, break the law, or endanger other customers' data. Where we can, we will tell you first.

3.Seats, plans and fair use

Access is licensed per seat. Each seat tier — View, Field, Lead and Admin — carries different capabilities, and your plan includes a defined pool of each. Contractor accounts are free and unlimited.

Bundle and Enterprise seat pools are soft caps. If you exceed your pool, we do not lock you out mid-month: the overage is measured at month end and billed at the standard per-seat rate. If there is no overage, there is no overage charge.

4.Fees, billing and renewal

  • Starter and Professional subscriptions are billed through Paddle, which acts as merchant of record and is responsible for charging applicable VAT.
  • Enterprise editions are invoice-billed in USD on Net-30 terms.
  • Annual plans are billed in advance and carry a 17% discount against the monthly rate.
  • Subscriptions renew automatically for successive terms unless cancelled before the renewal date.
  • Fees already paid for a term are non-refundable except where required by law, or where we have materially failed to provide the service.

We may change our prices. For an existing subscription, a price change takes effect at the next renewal, and we will give you notice before then so you can decide whether to continue.

5.Your data stays yours

You own the data you put into SafeProG — your incidents, assessments, permits, training records, documents and everything else. We do not sell it, and we do not use it to train AI models.

We process it to provide the service to you, as described in the Privacy Policy. You can export your data from the platform at any time while your subscription is active.

6.The gAnI assistant

gAnI drafts risk assessments, reads method statements, answers regulatory questions and suggests corrective actions. It is a drafting and research aid, not a substitute for a competent person.

Professional responsibility remains yours

Nothing gAnI produces is legal advice, a safety certification, or a competent-person sign-off. Every assessment, permit, method statement and legal determination must be reviewed and approved by a suitably qualified person in your organisation before it is relied on. You remain responsible for compliance with your own statutory duties.

7.Acceptable use

You agree not to:

  • upload content you have no right to share, or that is unlawful
  • attempt to access another organisation's data, or probe, scan or test the platform's security without our written permission
  • reverse engineer the service, or resell or sublicense access to it except under a signed reseller agreement
  • use the service to build a competing product
  • place automated load on the service that degrades it for other customers

8.Availability

We aim to keep SafeProG available continuously, and we design for it, but we do not promise uninterrupted service on standard plans. Planned maintenance is scheduled outside normal working hours where practical. Specific availability commitments, if any, are set out in an Enterprise agreement.

9.Ending the agreement

  • You may cancel at any time, effective at the end of your current billing term.
  • We may terminate for material breach if it is not remedied within 30 days of written notice.
  • On termination your data remains available for export for 30 days, after which it is deleted from live systems, and from backups within a further 90 days.
  • Executed agreements and their signature evidence are retained for the period stated in the relevant agreement, because both parties may need to prove what was signed.

10.Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under Irish law.

Subject to that, neither party is liable for indirect or consequential loss, loss of profit, or loss of anticipated savings; and our total liability in any twelve-month period is limited to the fees you paid us in that period.

SafeProG supports your safety management system. It does not discharge your legal duties as an employer, occupier, contractor or duty holder, and we are not liable for decisions your organisation takes on the basis of information held in it.

11.Changes to these terms

We may update these terms. For material changes affecting an active subscription we will give reasonable notice by email or in-app before they take effect. Continuing to use the service after that date means you accept the revised terms.

12.Governing law

These terms and any dispute arising out of them are governed by the laws of Ireland, and the parties submit to the exclusive jurisdiction of the courts of Ireland.
